Federal refund portal now live, but 330,000 eligible businesses face rolling deadlines they may not know are already running

On February 20, 2026, the Supreme Court issued a decision involving tariff authority under the International Emergency Economic Powers Act (IEEPA). The ruling affected an estimated $165 billion in duties collected from more than 330,000 importers across over 53 million customs entries between February 2025 and February 2026.

Refunds are not automatic. On April 20, 2026, U.S. Customs and Border Protection launched CAPE (Consolidated Administration and Processing of Entries), a new module within CBP’s ACE portal through which importers must actively file claims. Importers who do not come forward, submit accurate entry data, and file through the CAPE system will not receive a refund.

Adding to the urgency, the filing window is tied to the liquidation date of each individual entry. Importers generally have 180 days from liquidation to submit a claim. That clock runs per entry and is already ticking. Entries that miss the window are permanently ineligible.
